Privacy Policy
This policy describes how Efekto collects, uses and protects information when you use efekto.ai and the Efekto application (the "Service").
Data controller
The Service is operated jointly by LEMON AGENCY JAKUB ZWOLIŃSKI, al. Solidarności 68/121, 00-240 Warszawa, Poland, NIP PL7712932784, and LEMON AGENCY LLC, 30 N Gould St Ste N, Sheridan, WY 82801, United States (together "we", "us"). Both are owned and run by Jakub Zwoliński and act as joint controllers of personal data processed through the Service (Art. 26 GDPR). The Polish entity is the point of contact for all data-protection requests and serves as the EU representative of LEMON AGENCY LLC (Art. 27 GDPR). Contact: hello@efekto.ai.
1. Information we collect
- Account information: name, e-mail address, company details you provide when creating an account.
- Advertising account data (via Meta APIs): with your explicit authorization, we access your ad accounts, pages, campaigns, ad performance metrics and lead form submissions (
ads_management,pages_manage_ads,leads_retrieval) solely to provide the Service: creating and managing ads, retrieving performance data and delivering leads to you. - Lead data: contact details submitted by consumers through your lead forms. We process this data on your behalf as a processor; you are the data controller for your leads.
- Usage data: log and device information used for security and product improvement. Once you are signed in we also log usage events inside the app (screens opened, clicks, submitted forms, active time; never the text typed into fields) to improve onboarding and support; for this we may use a session-recording tool (PostHog, EU servers) with all form inputs masked. On the efekto.ai website (outside the app) such recording starts only after you agree in the consent banner; without consent the site only counts anonymous page views, with no cookies and no identification of the person. You can withdraw consent by clearing the site data in your browser.
2. How we use information
To operate the Service: generate and publish ad creatives, manage campaign lifecycle, deliver and score leads, provide analytics, billing and support. We do not sell personal data. We do not use your leads' data for any purpose other than providing the Service to you.
3. Legal bases (GDPR)
Performance of a contract (providing the Service), legitimate interest (security, product analytics) and consent where required. Data of EU users is stored in the EU.
4. Sub-processors
We use vetted infrastructure providers under data processing terms: Supabase (database, EU region), Vercel (hosting), Stripe (payments), Cloudflare (DNS/CDN), AI media providers used to render creative assets. A current list is available on request.
5. Retention
Account data - for the life of the account. Lead data - per your plan settings (default 24 months), deletable at any time. Meta access tokens are stored encrypted and removed immediately upon disconnection.
6. Your rights
Access, rectification, erasure, portability, restriction and objection - write to hello@efekto.ai. EU users may lodge a complaint with their supervisory authority (in Poland: UODO).
7. Data deletion
You can delete your data at any time - see Data deletion instructions. Disconnecting the Meta integration revokes our access to your Meta data.
7a. Text messages and phone calls
If you add your mobile number in your Efekto account, we use it only to send you a few account notifications (for example that your ads are ready for approval or that your trial ends soon) and, where you agreed to it next to the phone field, to call you about setting up your account, including with an automated AI assistant. Message frequency varies, at most a few messages per account. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help; you can also write to hello@efekto.ai.
We do not share or sell mobile phone numbers or SMS opt-in data and consent with third parties or affiliates for marketing or promotional purposes. Mobile information is shared only with service providers that deliver the messages and calls for us (such as our telecom provider), under contracts that prohibit any other use.
8. Changes
We will announce material changes by e-mail and on this page at least 14 days in advance.
